01Acceptance of Terms

Welcome to SnapTransfer ("we," "us," or "our"). These Terms of Service ("Terms") governing your access and use of the SnapTransfer web application operating at snaptransfer.cloud and its associated services (collectively, the "Service"). By accessing, browsing, or using the Service, you agree that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not access or use the Service.

02Eligibility & Accounts

Eligibility

You must be at least 13 years of age to use the Service. If you are under the age of majority in your jurisdiction, you may only use the Service with the consent and under the supervision of a parent or legal guardian.

Account Creation (Optional)

Registration is not required to send or receive files. However, to access certain advanced features, you may choose to create an account by providing an email address and creating a password.

You agree to provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for any and all activities that occur under your account. You must notify us immediately at snaptransfer.work@gmail.com of any unauthorized use or security breach of your account.

03Description of Service

SnapTransfer is an instant, secure peer-to-peer (P2P) file sharing application. The Service allows users to share files in two ways:

• Direct Peer-to-Peer (P2P) Transfers:Files are encrypted and streamed directly between the sender's browser and the recipient's browser using WebRTC technology. These transfers do not upload files to our servers at any point. Both users must be online simultaneously for the transfer to succeed.
• Optional Server-Hosted Transfers: If the recipient is offline, or if the sender prefers, files may be uploaded and held temporarily on our secure servers. These files are stored in an encrypted format and are automatically, permanently deleted within 24 hours of creation or upon manual deletion by the sender, whichever occurs first.

We reserve the right to modify, suspend, or discontinue the Service, or any part thereof (including features, transfer size limits, and storage duration), at any time with or without notice.

04User Conduct & Acceptable Use

You are solely responsible for the files you transfer and the actions you take through the Service. You agree that you will not upload, share, or transmit any files or content that:

• Are illegal, unlawful, or promote illegal activities under applicable local, national, or international laws.
• Violate or infringe upon the intellectual property, privacy, publicity, or other proprietary rights of any third party (including copyrighted material without permission).
• Contain malware, ransomware, viruses, spyware, keyloggers, Trojan horses, or any other destructive or harmful software or code.
• Depict child sexual abuse, exploitation, or abuse of any kind (CSAM), which will result in immediate termination, IP banning, and reporting to relevant authorities.
• Intend to harass, threaten, abuse, defame, or otherwise harm individuals or groups.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service, its servers, networks, or other users' accounts.
• Automate access to the Service using bots, scrapers, or other scripts without our explicit written permission.

SnapTransfer does not actively monitor, inspect, or decrypt the contents of files transferred. However, if we receive notice or have reasonable suspicion that a user is violating these Terms, we reserve the right to block transfers, suspend accounts, and terminate access immediately.

05Intellectual Property Rights

Your Files

You retain all ownership, copyrights, and intellectual property rights in the files you transfer. We do not claim any ownership rights over your files. By using the Service to transfer files, you warrant that you possess all necessary rights, licenses, and permissions to share and distribute that content.

Our Service

All rights, title, and interest in and to the Service (excluding user-transferred files), including but not limited to the codebase, website design, logo, illustrations, graphics, software, text, algorithms, and brand assets, are and will remain the exclusive property of SnapTransfer and its licensors. You may not copy, modify, distribute, or reverse engineer any part of the Service without our prior written consent.

06Disclaimers & Limitations

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, SNAPTRANSFER DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, AND ACCURACY.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR SECURE AGAINST SECURITY BREACHES. SNAPTRANSFER IS NOT A BACKUP SERVICE. YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING ORIGINAL COPIES OF ALL TRANSFERRED FILES. WE ARE NOT LIABLE FOR ANY LOSS, DELETION, CORRUPTION, OR FAILURE TO DELIVER TRANSFERRED CONTENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SNAPTRANSFER, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, SERVICE INTERRUPTIONS, COMPUTER DAMAGE, SYSTEM FAILURE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH (I) YOUR USE OF OR INABILITY TO USE THE SERVICE; (II) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR INFRASTRUCTURE AND DATA; (III) ANY CONTENT OR FILES TRANSFERRED OR STORED BY USERS; OR (IV) ANY TERMINATION OR SUSPENSION OF THE SERVICE.

07Indemnification

You agree to defend, indemnify, and hold harmless SnapTransfer, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal and accounting fees) arising out of or in any way connected to: (i) your access to or use of the Service; (ii) any files or content you transfer or store using the Service; (iii) your violation of these Terms; or (iv) your violation of any third-party rights, including intellectual property or privacy rights.

08Termination & Suspension

We reserve the right, without notice and at our sole discretion, to terminate or suspend your account and access to the Service, or block any active file transfers, for any reason, including but not limited to breach of these Terms, suspicion of fraudulent or abusive activity, or request by law enforcement. Upon termination, your right to use the Service will immediately cease. Any account-associated data or server-hosted files will be deleted in accordance with our Privacy Policy.

09Governing Law & Disputes

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these Terms or the Service shall be instituted exclusively in the competent courts located in India, and you hereby consent to the personal jurisdiction and venue of such courts.

10Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. When we make changes, we will update the "Last Updated" date at the top of this page. If a revision is material, we will make reasonable efforts to provide notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms. If you do not agree to the new terms, please stop using the Service.
